Booking and payment information
When you book studio time, photography, production, editing or another service, we may collect information necessary to administer your booking, including your contact details, appointment information, selected services and payment status.
Payments made online may be processed by a third-party payment provider. We do not ordinarily receive or store your full payment card details.
Studio, photography and production information
Because we operate a podcast, video, photography and content production studio, personal information we process may also include:
photographs;
video recordings;
audio recordings;
your voice;
your image and likeness;
interview or podcast content;
behind-the-scenes photographs or footage;
raw production files;
edited production files;
project instructions and creative briefs; and
names, job titles or other information intended to appear within content.
Where you are appearing in content created for one of our clients, the client may provide some of this information to us on your behalf.

3. Photography, video, audio and recorded content
Because recording and content creation form a core part of our business, there are circumstances in which your image, voice or likeness may be processed as part of providing our services.
When you or your organisation hires us to create content, we process those recordings for purposes such as:
recording the session;
transferring and backing up files;
editing;
colour correction;
audio processing;
creating clips or alternative versions;
applying titles, graphics or supplied branding;
delivering completed content; and
carrying out agreed revisions.
Where we are producing content directly for you, this processing will normally be necessary to perform our contract with you.
Where we are providing production services to another organisation and you are appearing as its employee, guest, contributor, interviewee or representative, we may process recordings on that organisation's instructions.
Depending on the particular project, The First Studio may therefore act either as a data controller or as a data processor acting on behalf of our client.
Use of client content by The First Studio
We will not automatically acquire ownership of a client's programme, interview, podcast or other content simply because it was recorded at our studio.
Any right for The First Studio to use photographs, footage, testimonials, behind-the-scenes material or completed work for our own portfolio, website, social media or promotional purposes will be subject to the relevant booking terms, production agreement, release or other permission applicable to that project.
Where separate consent is required, we will seek it.
4. Information about guests and contributors
A person making a studio booking may provide us with information about other people attending or participating in the session.
This may include their:
name;
organisation;
job title;
contact information;
production requirements; and
image, voice and recorded contribution.
If you book a production involving other people, you are responsible for ensuring that you have appropriate authority to provide us with information about those individuals and, where applicable, the necessary permissions for them to participate in the production.
5. Who we share information with
We do not sell your personal information.
We may share personal information with trusted service providers where this is reasonably necessary to operate our business or provide your services.
These may include:
Squarespace and website service providers;
booking and scheduling providers;
payment processors;
email and communications providers;
cloud storage and file-transfer providers;
accountants and professional advisers;
IT and security providers;
freelance camera operators, photographers, editors, engineers or production personnel working on your project; and
other suppliers required to fulfil a particular booking or production.
We only provide third parties with information reasonably required for the service they are providing.
We may also disclose information where required by law, a court, regulatory body or law-enforcement authority, or where reasonably necessary to establish, exercise or defend legal rights.
If we sell, restructure or transfer all or part of our business, relevant personal information may be transferred as part of that transaction subject to appropriate safeguards.
6. Squarespace
Our website is hosted by Squarespace.
Squarespace may process information about visitors including browser, network and device information, IP addresses, referring pages and pages viewed on our website.
We use Squarespace services to help us operate and manage our website and our relationship with visitors and customers.
Where Squarespace or another website service provider acts as an independent controller of your information, its own privacy terms will apply to that processing.
7. Cookies and analytics
Our website uses cookies and similar technologies.
Some cookies are strictly necessary for the website to function securely and correctly.
We may also use analytics, performance or other optional cookies to understand how visitors use the website and to help us improve it.
Where required by law, non-essential cookies will not be placed until you have provided the appropriate consent through our cookie controls.

8. Email marketing
If you subscribe to The First Studio mailing list, we may send you news, studio updates, events, offers or information about our services.

Unsubscribing from marketing will not prevent us from sending important service communications relating to an active booking, payment, membership, contract or enquiry.
We may retain limited information recording that you have opted out so that we can respect your preference in the future.
9. How long we keep your information
We only retain personal information for as long as reasonably necessary for the purpose for which it was collected, including satisfying legal, accounting and contractual obligations.
Retention periods vary depending on the information.
Production files
Unless otherwise agreed as part of a package or project:
Raw recording files are normally retained for 14 days following delivery.
Clients are responsible for downloading and securely backing up their files during this period.
Files may be deleted after the applicable retention period and we cannot guarantee that they can be recovered afterwards.
Edited or project files may be retained for longer where required to complete agreed revisions, deliver the project, resolve a dispute or meet another contractual requirement.
Financial records
Invoices, payment records and relevant business records may be retained for at least six years, where required for accounting, tax or other legal purposes.
Booking and enquiry information
Booking information, correspondence and customer records are retained for as long as reasonably necessary to:
administer the customer relationship;
provide services;
respond to questions;
manage repeat bookings;
deal with complaints or disputes; and
establish or defend legal claims.
We periodically review information we hold and delete or anonymise information we no longer reasonably require.
10. International transfers
Some of the technology and service providers we use may process or store information outside the United Kingdom.
Where personal information is transferred internationally, we will take reasonable steps to ensure an appropriate legal mechanism or safeguard is in place where required by UK data protection law.
This may include relying on an adequacy regulation, approved contractual safeguards or another lawful transfer mechanism.
11. Keeping information secure
We take reasonable technical and organisational measures designed to protect personal information against:

Access to customer and production information is restricted to people who reasonably require it to carry out their work.

Our website and online booking services are primarily intended for adults.
Where a person under 18 is going to participate in a photography, video, audio or other production session, appropriate consent or authorisation should be arranged before the session where required.

Our website may contain links to third-party websites, social-media platforms or external services.
Those organisations operate their own websites and privacy practices. We are not responsible for how third parties process personal information when you interact directly with their services.

We may update this Privacy Policy from time to time to reflect changes to our services, technology, suppliers or legal obligations.

Booking Policy
Booking Policy
The First Studio Group Ltd
This Booking Policy explains how bookings at The First Studio work. It should be read alongside our Cancellation Policy and Terms & Conditions.
Booking & Payment
All standard bookings must be paid in full at the time of booking.
A booking is not confirmed until payment has been received and confirmation has been issued by The First Studio.
Approved corporate clients may book on invoice. Unless otherwise agreed in writing, corporate invoices are payable within 14 days of the invoice date.
The First Studio Group Ltd is not currently VAT registered, and VAT is therefore not currently added to our prices. If our VAT status changes, applicable VAT will be shown clearly on future quotes, invoices and bookings.
Minimum Booking
The minimum studio booking is 2 hours.
For most podcast, video and content sessions, we recommend booking beyond the minimum to allow sufficient time for setup, soundchecks, recording and pack-down.
Your Booking Time
Your booking time includes:
arrival and access;
equipment setup;
lighting adjustments;
soundchecks;
guest preparation;
recording;
equipment or set changes; and
pack-down and departure.
Clients should therefore book enough time to complete their entire session within the reserved period.
Late Arrival
If you or your guests arrive late, your booking will still finish at the original scheduled end time.
We cannot extend a session because of late arrival where this affects another booking or studio availability.
No refund or credit will be provided for studio time lost because of late arrival.
Overrunning
Where studio availability allows, a session may continue beyond its scheduled finish time.
Additional time is charged in 30-minute increments.
For standard bookings, additional time is charged at the applicable pro-rata booking rate plus 10%.
The 10% overrun premium does not apply to members. Members pay the normal applicable pro-rata rate.
An overrun is always subject to studio availability and cannot be guaranteed.
Number of Guests
Standard bookings include up to 4 people.
Additional attendees are charged at £20 per additional person, per hour.
The person or company making the booking is responsible for everyone attending as part of their booking, including:
guests;
presenters;
interviewees;
talent;
crew;
photographers;
contractors; and
other visitors.
Studio Access
Members may access the studio 24 hours a day, 7 days a week, subject to the terms of their membership, building access, safety requirements and any temporary closures.
Non-members may access the studio during our published opening hours unless alternative arrangements have been expressly agreed by The First Studio.
The First Studio reserves the right to request valid photographic identification, particularly for first-time clients, members and out-of-hours access.
Engineers & Technical Support
Where an engineer or studio operator is included in or added to a booking, they will provide reasonable assistance with areas such as:
studio setup;
microphones;
cameras;
lighting;
recording equipment; and
operation of the agreed studio systems.
We take reasonable care in operating and maintaining our equipment. However, no recording environment can completely eliminate the possibility of equipment failure, corrupted files, connectivity issues, power interruption or other unexpected technical problems.

External Equipment & Props
Clients may bring their own cameras, lighting, props, equipment and set pieces provided they can be used safely and without damaging the studio.
The following require prior approval from The First Studio:
drilling or fixing into walls;
painting;
adhesives likely to mark surfaces;
smoke or haze;
open flames;
significant furniture movement;
unusually heavy equipment; and
anything likely to affect the studio, neighbouring units, electrical supply or fire safety.
Clients are responsible for ensuring their own equipment is safe and suitable for use.
For larger productions, dry hires or productions involving external crews or substantial equipment, The First Studio may require evidence of appropriate public liability insurance.
Studio Rules
The following are not permitted unless The First Studio has expressly agreed otherwise:
smoking;
vaping;
illegal drugs;
open flames;
pets;
alcohol; and
children under the age of 15.
Assistance animals will be accommodated where required by law.
Illegal, dangerous, abusive, hateful, defamatory, pornographic or otherwise prohibited activity is not permitted.
The First Studio reserves the right to refuse or immediately terminate a session where behaviour or content presents a safety, legal, reputational or operational risk.
Serious breaches may result in the session being terminated without refund.
Damage
The person or company making the booking is financially responsible for damage caused by them or anyone attending under their booking.
This includes damage to:
cameras;
microphones;
lighting;
computers;
studio equipment;
furniture;
walls;
flooring;
fixtures and fittings; and
the wider premises.
The client will be responsible for the reasonable cost of repair or replacement.
Cleaning
Clients must leave the studio in a reasonably clean and tidy condition.
Where additional cleaning beyond normal studio use is required, a minimum £50 additional cleaning charge will apply.
Where the actual cost of cleaning, specialist cleaning, repair, waste removal or restoration is higher, the client will also be responsible for those reasonable additional costs.
Personal Belongings
Clients and guests are responsible for their own belongings, equipment and property while at the studio.
The First Studio accepts no responsibility for loss, theft or damage to personal belongings or client equipment except to the extent that liability cannot legally be excluded.
Booking Transfers
Bookings may not be sold, transferred or given to another person or company without prior written approval from The First Studio.
Editing
Where editing is included in a service, one round of reasonable revisions is included unless otherwise stated in your quote or package.
Further revisions or substantial changes to the original brief may be charged separately.
A change of creative preference after delivery does not automatically entitle a client to a refund, free re-record or additional editing.
Where The First Studio has made a genuine production or editing error, we will take reasonable steps to remedy it.
Files
Where raw recording files are provided or made available, The First Studio will normally retain them for 14 days following delivery.
Clients are responsible for downloading and securely backing up their files during this period.
Files may be permanently deleted after 14 days and recovery cannot be guaranteed.

Our cancellation and rescheduling rules are set out in our separate Cancellation Policy.
By making a booking, you confirm that you have read and accepted our Booking Policy, Cancellation Policy and Terms & Conditions.

Cancellation & Rescheduling Policy
The First Studio Group Ltd
We understand that plans sometimes change. Because studio bookings reserve specific time and capacity that may be difficult to resell at short notice, the following cancellation and rescheduling policy applies.
For this policy, a Working Day means Monday to Friday, excluding public and bank holidays in England.
Standard Bookings
Cancelling 5 or More Working Days Before Your Booking
If you cancel at least 5 Working Days before your scheduled booking, you will receive a refund of the amount paid, less a 5% administration fee.
The booking date itself is not counted when calculating the notice period.
Cancelling Within 5 Working Days
If you cancel with less than 5 Working Days' notice, the booking is non-refundable.
No refund or studio credit is automatically due.
Member Cancellation Benefit
Members receive an enhanced cancellation benefit.
Where a member cancels:
5 or more Working Days before the booking:
The normal refund applies, less the 5% administration fee.
Less than 5 Working Days but at least 48 hours before the booking:
The member will receive a 50% refund of the booking amount paid.
No additional administration fee will be deducted from that 50% refund.
Less than 48 hours before the booking:
The booking is 100% non-refundable.
The 48-hour period is calculated from the scheduled start time of the booking.
Rescheduling
A booking may be rescheduled once without a rescheduling fee provided the request is received at least 5 Working Days before the scheduled booking.
The replacement date is subject to studio availability.
Once a booking has been rescheduled:
it cannot be rescheduled again;
it becomes non-refundable; and
it cannot be transferred to another person or company.
Requests made with less than 5 Working Days' notice do not qualify for rescheduling under this policy.
No-Shows
Failure to attend a booking without prior cancellation is treated as a no-show.
No-shows are 100% non-refundable and cannot be rescheduled or converted into studio credit.
Late Arrival
Arriving late does not change the scheduled booking period.
The booking will finish at its original scheduled end time and no refund, credit or automatic extension will be provided for missed time.
Illness, Transport Problems & Personal Circumstances
Our standard cancellation rules also apply where a cancellation results from circumstances such as:
illness;
childcare problems;
transport disruption;
traffic;
diary conflicts;
travel delays; or
changes to your production or guest availability.
However, The First Studio may choose to make an exception in genuinely exceptional circumstances.
Any exception is entirely at The First Studio's discretion and does not create an obligation to make the same exception on another occasion.
Cancellation by The First Studio
In the unlikely event that The First Studio has to cancel your booking and cannot provide the booked service, you may choose either:
a full refund of the amount paid for the affected booking; or
to reschedule the booking to another mutually agreed available date.
The First Studio will not be responsible for additional or third-party costs resulting from the cancellation, including:
travel;
accommodation;
talent fees;
crew fees;
equipment hire;
lost earnings;
lost opportunities; or
other consequential costs,
except where liability cannot legally be excluded.
Technical Problems
A technical issue does not automatically constitute a cancellation.
Where a genuine technical failure caused by The First Studio materially affects the service, we will consider the circumstances and provide an appropriate remedy, which may include a re-record, additional studio time, rescheduling, partial refund or refund where appropriate.
Creative preference alone does not constitute a technical failure and does not automatically entitle the client to a refund or free re-record.
Statutory Rights
Nothing in this Cancellation Policy limits or excludes any cancellation, refund or other rights that a consumer is legally entitled to exercise and which cannot lawfully be excluded or restricted.
Terms & Conditions
Terms & Conditions
The First Studio Group Ltd
These Terms & Conditions apply to bookings and services provided by The First Studio Group Ltd, trading as The First Studio ("The First Studio", "TFSG", "we", "us" or "our").
They apply together with our Booking Policy, Cancellation Policy and Privacy Policy.
By making a booking, accepting a quotation, paying an invoice, entering into an agreement for our services or using our studio, you agree to these Terms & Conditions.
1. Bookings
A standard booking is confirmed once:
the booking has been accepted by The First Studio; and
full payment has been received.
Unless otherwise agreed, all standard bookings require 100% payment upfront.
Approved corporate clients may book on invoice.
Corporate invoices are payable within 14 days of the invoice date, unless otherwise agreed in writing.
We may refuse a booking at our reasonable discretion.
2. Prices & VAT
The First Studio Group Ltd is not currently VAT registered.
VAT is therefore not currently charged on our prices.
If our VAT registration status changes, any VAT legally payable on future bookings will be clearly stated before the relevant booking is completed.
3. Minimum Booking
The minimum booking period is 2 hours.
We recommend allowing additional time beyond the minimum for most recording sessions.
4. Booking Period
The booked period includes all time required for:
access;
setup;
soundchecks;
lighting;
equipment changes;
recording;
photography;
guest preparation;
pack-down; and
departure.
Clients must vacate the studio by the scheduled finish time unless an extension has been agreed.
5. Late Arrival
Late arrival does not extend the booking.
The session will finish at the originally scheduled end time.
No refund or credit will be given for time lost because a client, guest or member of their production arrives late.
6. Overruns
Where studio availability allows, additional time may be purchased in 30-minute increments.
Standard clients will be charged the applicable pro-rata booking rate plus a 10% overrun premium.
Members will be charged the normal applicable pro-rata rate without the 10% premium.
Additional time is subject to availability and cannot be guaranteed.
7. Attendance
Unless otherwise specified, studio bookings include up to 4 attendees.
Additional attendees are charged at £20 per additional person, per hour.
The booking holder is responsible for the behaviour and actions of everyone attending under their booking.
8. Cancellation
Bookings cancelled at least 5 Working Days before the scheduled booking will be refunded less a 5% administration fee.
Bookings cancelled with less than 5 Working Days' notice are non-refundable, subject to the member benefit below.
A Working Day means Monday to Friday excluding public and bank holidays in England.
9. Member Cancellation Benefit
Members cancelling with less than 5 Working Days but at least 48 hours' notice will receive a 50% refund.
No additional administration fee is deducted from that refund.
Bookings cancelled by members less than 48 hours before the scheduled start time are non-refundable.
10. Rescheduling
A booking may be rescheduled once without a rescheduling fee if at least 5 Working Days' notice is provided.
The new booking date is subject to availability.
Once rescheduled, the booking becomes:
non-refundable;
non-transferable; and
ineligible for further rescheduling.
11. No-Shows
No-shows are 100% non-refundable.
12. Exceptional Circumstances
Cancellation rules remain applicable to illness, transport disruption, childcare problems, travel disruption, guest availability and other personal circumstances.
The First Studio may make an exception in exceptional circumstances at its sole discretion.
An exception on one occasion does not create a precedent or obligation to make a future exception.
Nothing in these Terms affects rights that cannot legally be excluded.
13. Cancellation by The First Studio
If The First Studio has to cancel a booking and cannot provide the booked service, the client may choose:
a full refund of the amount paid for that booking; or
a replacement booking on an available mutually agreed date.
To the fullest extent permitted by law, The First Studio will not be responsible for third-party or consequential costs resulting from a cancellation, including travel, accommodation, crew, talent, equipment hire, loss of earnings or loss of opportunity.
14. Studio Access
Members may access the studio 24/7 subject to:
membership terms;
building access;
safety requirements;
maintenance;
temporary closures; and
reasonable operational restrictions.
Non-members may access the studio during published operating hours unless expressly agreed otherwise.
The First Studio may require photographic identification before permitting access.
15. Conduct
Clients must behave responsibly and safely while on the premises.
The following are prohibited unless expressly approved where applicable:
smoking;
vaping;
illegal drugs;
open flames;
pets;
alcohol; and
children under 15.
Nothing in these Terms is intended to restrict legally protected assistance animals.
16. Prohibited Productions
The studio must not be used to create or facilitate material or activity that is:
illegal;
dangerous;
abusive;
threatening;
hateful;
pornographic;
defamatory;
deliberately damaging to another person's rights;
likely to cause material damage to the studio or premises; or
otherwise reasonably considered unacceptable by The First Studio.
We may refuse to begin or may immediately terminate a production where we reasonably believe these conditions are being breached.
A booking terminated because of serious client misconduct or a serious breach of these Terms may be ended without refund.
17. External Equipment, Sets & Props
Clients may bring external equipment, props and set pieces provided they are safe and do not damage the studio.
Prior written approval is required before:
drilling;
attaching fixtures;
painting;
using potentially damaging adhesives;
using smoke or haze;
using open flames;
moving substantial furniture;
installing unusually heavy equipment; or
materially altering the studio.
The client is responsible for ensuring that equipment brought onto the premises is safe, suitable and appropriately operated.
18. Insurance
The First Studio reserves the right to require evidence of appropriate public liability insurance before permitting a booking or production.
This may particularly apply to:
dry hire;
external crews;
large productions;
substantial external equipment; or
productions presenting additional risk.
Failure to provide requested evidence may result in access being refused.
19. Damage
The booking holder is responsible for damage caused by them or anyone attending under their booking.
The client must pay the reasonable cost of repairing or replacing damaged property, including studio equipment, furniture, cameras, microphones, lighting, fixtures and fittings.
Where an item cannot reasonably be repaired, the client may be charged the reasonable replacement cost.
20. Cleaning
The studio must be left in a reasonably clean and tidy condition.
Where additional cleaning beyond normal use is required, a minimum £50 cleaning charge will apply.
Where specialist cleaning, waste removal, repair, restoration or other work costs more than £50, the client will also be responsible for the reasonable additional costs incurred.
21. Personal Property
All property brought onto the premises remains at the owner's risk.
Clients are responsible for protecting, supervising and removing their own belongings and equipment.
To the fullest extent permitted by law, The First Studio accepts no liability for theft, loss or damage to client or guest property.
22. Equipment & Technical Services
The First Studio will take reasonable care and skill in providing its services and maintaining and operating its equipment.
Where an engineer or operator is included, they will provide reasonable assistance with the agreed technical setup and production.
However, technical production inherently involves risks including:
hardware failure;
recording failure;
corrupted media;
software errors;
internet outages;
power interruption;
storage failure; and
unexpected equipment malfunction.
We do not guarantee that such issues can never occur.
Where a technical problem caused by The First Studio materially affects a production, we will assess the circumstances and provide an appropriate remedy where required.
23. Creative Satisfaction
Creative work is subjective.
A client's dislike of a creative choice, style, performance, appearance or other subjective element does not automatically mean the service was defective and does not automatically entitle the client to a refund or re-record.
Where The First Studio has made a genuine production or editing error, we will take reasonable steps to remedy it.
Nothing in this clause affects a consumer's statutory rights in relation to services that have not been provided with reasonable care and skill.
24. Editing & Revisions
Where editing is included in the agreed service, one round of reasonable revisions is included unless otherwise stated.
Additional revisions may be charged separately.
A revision means a reasonable amendment to the agreed edit.
Material changes to the original brief, additional deliverables or a request to substantially recreate the production may be treated as additional work and quoted separately.
25. Client-Supplied Materials
Clients remain responsible for all materials they provide or instruct us to use.
This includes:
music;
logos;
trade marks;
photographs;
artwork;
scripts;
graphics;
video footage;
archive material;
fonts; and
other third-party content.
The client warrants that it has all licences, permissions, consents and other rights reasonably required for the intended use of those materials.
The client is responsible for claims resulting from material supplied by the client or used at the client's instruction, except to the extent the claim results from The First Studio's own unauthorised use.
26. Participants & Permissions
The booking holder is responsible for ensuring that people participating in their production have been appropriately informed that recording will take place.
The client is responsible for obtaining any releases, permissions or consents reasonably required from:
presenters;
interviewees;
performers;
guests;
employees;
models; and
other contributors,
where those permissions are required for the client's intended use of the production.
The First Studio may also request individual releases where appropriate.
27. Intellectual Property — Productions Created by The First Studio
Unless otherwise agreed in writing, intellectual property rights in material created or produced by or on behalf of The First Studio as part of our production services remain with The First Studio, subject to any third-party rights.
This may include:
video recordings;
photography;
audio recordings;
edits;
graphics created by us;
raw footage;
production files; and
project files.
Once the agreed fees have been paid in full, the client receives a perpetual, worldwide, royalty-free licence to use the final content delivered to them.
This licence allows the client to reproduce, publish, display, distribute, edit, adapt and commercially use the final delivered content for its own purposes.
The client may allow its agencies, distributors, platforms, broadcasters, partners and service providers to use the final content to the extent reasonably necessary for those purposes.
Unless expressly included in the agreed package, this licence does not require The First Studio to provide editable project files, working files or other internal production materials.
28. Client Materials
The First Studio does not acquire ownership of pre-existing intellectual property supplied by the client.
Client logos, brands, trade marks, scripts, presentations, existing footage and other client-owned assets remain the property of the client or their respective rights holders.
The client grants The First Studio permission to use those materials solely as reasonably necessary to perform the agreed services.
29. Dry Hire
Where the client hires the studio on a dry-hire basis and creates content using its own cameras, recording equipment and production personnel, the content created by the client remains the client's property.
The First Studio does not claim copyright ownership merely because the content was created on our premises.
30. Promotional Use
Unless the client tells us otherwise in writing before the session, the client permits The First Studio to use reasonable:
excerpts;
clips;
still photographs;
behind-the-scenes material; and
examples of completed work
for The First Studio's:
website;
portfolio;
social media;
showreels;
awards submissions;
advertising;
promotional campaigns; and
sales materials.
We will not knowingly publish material while it remains confidential, subject to an NDA, under embargo or forms part of an unreleased confidential project.
Where content has not yet been made public by the client, we will either wait until it has been publicly released or obtain permission before publishing it ourselves.
A client may opt out of promotional use by notifying The First Studio in writing before the session.
Where additional individual consent or another lawful basis is required for a particular use of someone's personal data, The First Studio will handle that use in accordance with applicable data protection law.
31. Confidentiality
The First Studio will treat non-public information received in connection with client productions as confidential.
This includes unreleased content and confidential project information.
We will not intentionally disclose confidential client information to third parties except:
where necessary to provide the agreed services;
to employees, contractors or production partners who reasonably need access;
where the client has authorised disclosure;
where the information is already legitimately public; or
where disclosure is required by law.
A separate NDA may be entered into where appropriate.
32. Files & Storage
Unless otherwise agreed, raw recording files are retained for 14 days following delivery.
Clients are responsible for downloading and backing up their files during that period.
After the retention period:
files may be permanently deleted;
continued storage is not guaranteed; and
recovery may not be possible.
The First Studio is not responsible for a client's failure to download or back up files after they have been made available.
33. Booking Transfers
A booking may not be sold, assigned or transferred to another person or organisation without prior written approval from The First Studio.
34. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded.
Subject to those exceptions, and to the fullest extent permitted by law, The First Studio's total aggregate liability arising from a particular booking will not exceed the amount actually paid by the client for the booking giving rise to the claim.
To the fullest extent permitted by law, The First Studio is not responsible for indirect or consequential losses, including loss of profit, loss of revenue, loss of opportunity, travel costs, accommodation costs, crew costs or talent costs.
Nothing in these Terms affects mandatory consumer rights.
35. Responsibility for Guests
The booking holder is responsible for ensuring that all guests, employees, talent, crew, contractors and other attendees comply with these Terms.
Any additional charges, damage or losses caused by those people may be charged to the booking holder.
36. Safety
Clients must comply with reasonable safety instructions given by The First Studio or the management of the building in which the studio operates.
Fire exits, access routes and safety equipment must not be obstructed.
The First Studio may stop any activity it reasonably considers unsafe.
37. Force Majeure & Events Outside Our Control
The First Studio will not be responsible for failure or delay caused by events outside our reasonable control.
Where such an event means we cannot provide the booked session, the client will be offered either a full refund for the affected booking or the opportunity to reschedule.
The First Studio will not be liable for additional third-party costs arising from such events except where liability cannot legally be excluded.
38. Changes to a Booking
Any material change to the scope of a production may result in additional charges.
This may include changes to:
recording duration;
attendee numbers;
equipment requirements;
crew requirements;
editing requirements;
deliverables; or
the original creative brief.
We will notify the client of material additional charges before carrying out additional chargeable work wherever reasonably practicable.
39. Consumer Rights
If you are booking as an individual consumer rather than for business purposes, you may have statutory rights in addition to these Terms.
Nothing in these Terms is intended to exclude, restrict or replace rights which cannot lawfully be excluded or restricted.
Where mandatory consumer law gives you greater rights than these Terms, the applicable law will take precedence.
40. Privacy
Personal information is processed in accordance with The First Studio's Privacy Policy.
41. Changes to These Terms
We may update these Terms from time to time.
The version applicable to a booking will normally be the version in effect when the booking was confirmed, unless a change is required by law or the parties agree otherwise.
42. Governing Law
These Terms and any dispute or claim arising from them are governed by the laws of England and Wales.
Where legally permitted, the courts of England and Wales will have jurisdiction.
Nothing in this clause removes any mandatory right a consumer may have to bring proceedings in another court where applicable law provides that right.
